1. Introduction

Welcome to mw1.solutions. These Terms of Service ("Terms") govern your use of the mw1.solutions website and the MW1 mobile application (collectively, the "Platform"), operated by mw1.solutions ("we," "us," or "our").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. About Our Platform

mw1.solutions is Malawi's digital marketplace. We provide a platform for:

• Discovering and listing verified businesses across Malawi
• Finding and posting job opportunities
• Browsing and listing properties for rent or sale
• Buying and selling goods in the marketplace

We act as a platform connecting users. We are not a party to any transaction between users and do not guarantee the quality, safety, or legality of items, services, or properties listed.

3. Account Registration

• You must be at least 16 years old to create an account.
• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account at mw1.solutions@outlook.com.

4. User Content & Listings

4.1 Your Responsibilities

When you create a listing (business, job, property, or marketplace item), you agree that:

• All information provided is accurate, truthful, and not misleading
• You have the legal right to list the business, property, job, or item
• The listing does not infringe on any third party's intellectual property or other rights
• The listing complies with all applicable Malawian laws and regulations

4.2 Prohibited Content

You may not list or post content that:

• Is illegal, fraudulent, or deceptive
• Promotes violence, hate speech, discrimination, or harassment
• Contains malware, spam, or phishing attempts
• Infringes intellectual property rights
• Is sexually explicit or obscene
• Involves controlled substances, weapons, or counterfeit goods
• Violates Malawian law or public policy

4.3 Content Moderation

We reserve the right to review, edit, or remove any listing or content that violates these Terms, without prior notice. Repeated violations may result in account suspension or termination.

5. Transactions Between Users

• We are not responsible for the quality, safety, legality, or availability of items, services, or properties listed.
• We do not verify the identity, background, or credentials of all users beyond business listing verification.
• We recommend meeting in safe, public locations for in-person transactions.
• Disputes between users should be resolved directly between the parties involved.

6. Fees & Payments

• Browsing: Free for all users.
• Listing a business: Free (subject to verification and approval).
• Posting a job: Free.
• Listing a property: Free.
• Marketplace listings: Free to list. Optional boost for MWK 2,000 for increased visibility.
• Premium features: Paid features may be available and will be clearly priced before purchase.

Payments are processed securely through PayChangu. We reserve the right to introduce or modify fees with 30 days' notice to users.

7. Intellectual Property

• The mw1.solutions name, logo, design, and all Platform content (excluding user-generated content) are owned by mw1.solutions and protected by intellectual property laws.
• By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content on the Platform and related marketing channels.
• You retain ownership of your content and can remove it at any time by deleting your listing.
• You may not copy, reproduce, or redistribute any part of the Platform without our written permission.

8. Account Suspension & Termination

We may suspend or terminate your account if you:

• Violate these Terms or our Privacy Policy
• Post fraudulent or misleading listings
• Engage in abusive or harmful behaviour toward other users
• Use the Platform for illegal purposes
• Create multiple accounts to circumvent restrictions
• Attempt to scrape, crawl, or extract data from the Platform without permission

You may delete your account at any time by contacting us at mw1.solutions@outlook.com. Upon deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties, express or implied, regarding:

• The accuracy, completeness, or reliability of any listing or content
• The availability or uninterrupted operation of the Platform
• The safety or legality of transactions between users
• The suitability of the Platform for any particular purpose
• That the Platform will be free from errors, viruses, or security vulnerabilities

10. Limitation of Liability

To the maximum extent permitted by Malawian law, mw1.solutions shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from transactions between users
• Content posted by third-party users
• Service interruptions or data loss

Our total aggregate liability for any claim arising from or relating to these Terms or the Platform shall not exceed MWK 50,000.

11. Indemnification

You agree to indemnify, defend, and hold mw1.solutions harmless from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, your violation of these Terms, or your infringement of any third party's rights.

12. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Malawi. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malawi.

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at mw1.solutions@outlook.com. We will try to resolve the matter within 30 days.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. For significant changes, we will provide at least 30 days' notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

14. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and mw1.solutions regarding the Platform.
